Terms and Conditions of Use
Please read these Terms in full before using any SendiCash website or service. By continuing to browse or by registering an account you agree to every provision below; if you disagree, you must stop using the site immediately.

1. Introduction and your acceptance of the terms of use
1.1. PLEASE READ THESE TERMS OF USE CAREFULLY IN THEIR ENTIRETY BEFORE USING THE WEBSITE WWW.SENDICASH.COM OR ANY SERVICE OFFERED THEREIN. BY USING THE WEBSITE OR OTHERWISE ACCESSING OR USING OUR SERVICES, YOU AGREE TO THESE TERMS OF USE. IF YOU DO NOT ACCEPT THE TERMS OF USE OR ANY PROVISION THEREIN, DO NOT ACCESS THE WEBSITE OR USE THE SERVICES.
1.2. SendiCash is a company incorporated under the laws of Uganda with a registered office at Plot 1026/28, Mawanda Road, Kampala. We may be referred to as "the Company," "we," "us," or "our."
1.3. Users of the SendiCash site (the "Site") are referred to as "you" or "your." By using the Site and/or registering to use our services you accept and comply with these Terms of Use. Read them carefully before using the Site or any services. If you do not agree, you must not use the Site or the Services.
2. Registration and your account eligibility
By opening an account (the "Account"), you represent and warrant that you have accepted these Terms, are at least 18 years old, of sound mind and capable of taking responsibility for your actions, and that all information submitted to us is true, current, complete, and matches the registered name(s) on the payment accounts you use.
3. Personal use of your account
3.1. The Site is for personal and non-commercial use only; only one Account is allowed. 3.2. You must not use any Account other than your own or help others obtain unauthorized access. 3.3. You must provide current, accurate, and complete information and keep it updated; we may request additional documentation at any time. 3.4. We may verify your details by requesting government ID, proof of address, proof of payment method, notarised copies, and video calls; we may reject documents without providing specific reasons. 3.5. We may conduct further background checks and request more documentation. 3.6. You authorise us to perform inquiries via third-party providers to prevent fraud or other illegal activity. 3.7. We may deny, limit, or suspend accounts at our discretion. 3.8. You are responsible for maintaining the confidentiality of your Account, safeguarding digital currency, and all activities on your Account. 3.9. You must keep your contact details current to receive security alerts. 3.10. Unauthorized account creation or use will result in suspension or termination. 3.11. Notify us immediately at info@sendicash.com of any unauthorized access. 3.12. We may terminate accounts for non-compliance. 3.13. You are responsible for all actions of third parties using your Account. 3.14. You must not use the Services for criminal activity. 3.15. You agree to receive promotional and informational emails.
4. Provision of the services
4.1. Members may buy supported digital currencies (the "Digital Currency") from the Company. 4.2. At our discretion we may also allow Members to sell Digital Currency to us. 4.3. After your Account is verified you may transact per order in exchange for UGX or other supported fiat currencies ("Fiat Money"). 4.4. Payment methods include bank deposits and mobile wallets; availability depends on your location, identity data, and processor limits. 4.5. Bank deposits may be adjusted based on net funds received. 4.6. We will use reasonable efforts to deliver purchased Digital Currency promptly, though some delays may occur. 4.7. Delivery is made to the wallet address you provide and verify; if you fail to verify within 30 days we may deliver to the provided address. 4.8. We are not liable for errors in your instructions. 4.9. We do not guarantee any value or liquidity for Digital Currency, and we are not obliged to buy any Digital Currency from you.
5. Price of digital currency and execution of your order
5.1. Rates are derived from the quoted price. 5.2. Due to volatility, prices displayed on the Site may differ from the final executed price. 5.3. The final price is determined upon confirmation that payment has been received or Digital Currency has been credited to us. 5.4. The Final Price may be higher or lower than previously shown. 5.5. Orders remain pending until execution following satisfactory KYC completion. 5.6. After execution we will deliver Digital Currency to your wallet or Fiat Money to your bank/mobile account and provide a transaction confirmation. 5.7. Payments are net of applicable fees. 5.8. Executed transactions are non-cancellable; refunds for cancelled orders are subject to deductions and exchange rates determined by us. 5.9. If payment is unsuccessful we may cancel, partially fulfil, or debit alternative payment methods. 5.10. You must use wallet addresses under your sole control. 5.11. We may refuse or cancel orders if required by law or policy, or if they present risk to our operations or reputation.
6. Users content
You warrant that any content you upload will not be false, infringing, obscene, unlawful, or harmful to our reputation. We may remove content at our discretion and assume no obligation to review it. Reliance on user content is at your own risk.
7. Payment transactions, third party processors, and chargebacks
You are responsible for all payments. We may use third-party processors and share information as needed. If fraudulent activity or chargebacks occur we may close your Account, reverse payments, inform authorities, and employ collections. You agree not to initiate chargebacks and to reimburse us for any losses caused by reversals. We may withhold payments pending verification.
8. Use of our technology and intellectual property
You may only use our software for personal purposes and must not copy, reverse engineer, distribute, or engage in other prohibited acts. You are liable for damages from such acts and must notify us if you become aware of them. Trademarks and content remain our property. We do not guarantee site availability or immunity from malware. Confidential information shared with you must remain confidential.
9. Compliance
You must ensure your use complies with Ugandan laws, sanctions, and tax obligations. We may refuse service if suspected of prohibited activity or if KYC/AML requirements are unmet. You warrant compliance with international sanctions and take responsibility for any applicable taxes.
10. Account suspension, termination, and cancellation
We may suspend or terminate your account or refuse transactions for numerous reasons, including breaches, suspicious activity, legal requests, inactivity, or reputational risk. Termination by you requires emailing info@sendicash.com. Upon termination you must cease use, settle outstanding obligations, and we may retain information per legal requirements. We are not required to disclose findings related to suspension decisions.
11. Limitations of liability; release
Services are provided "as is" without warranties. We are not liable for direct or indirect losses arising from use of the Site, and any claim must be filed within one year. Liability is capped at USD 50. We are not responsible for transfers made with incorrect wallet or payment details provided by you. You release us from disputes between you and other users.
12. Indemnification
You agree to indemnify and hold us harmless from claims, liabilities, and costs arising from your breach of the Terms, your use of the Services, or any legal violations by you or those using your Account.
13. Modifications to the terms of use
We may amend these Terms due to legal, regulatory, security, or service-related reasons. Updates will be posted on the Site or sent via email and take effect 24 hours after posting (or earlier if required). Continued use constitutes acceptance. If you disagree, discontinue use and close your Account.
14. External websites
We provide links to external websites for convenience only and are not responsible for their content, availability, security, or privacy practices. Use them at your own risk.
15. No financial advice
We do not provide investment advice, recommendations, or guidance. Any information provided is for informational purposes only. Trading decisions are solely yours and at your own risk.
16. Lack of financial regulation
Our business involves facilitating digital currency transactions in an open payment system that may not be regulated. Regulatory changes may require amendments or termination of the Services. Legislative actions may affect the use, transfer, or value of digital currency.
17. KYC, AML, and CTF procedures
We have implemented KYC/AML/CTF procedures to identify and mitigate misuse of our Services. We may refuse clients or transactions if we suspect money laundering or other financial crimes, and we may report suspicions to authorities without notice. We collect personal information from you or external sources and handle it per our Privacy Policy.
18. Risks
Trading digital currencies involves significant risks including volatility, lack of backing, potential loss of value, market illiquidity, technical failures, and irreversible transactions. You should carefully assess whether holding digital currency is suitable given your financial situation.
19. Customer service
We may contact you regarding your use of the Services. If you have questions or complaints, contact info@sendicash.com with identifying information. Calls may be recorded, and abusive behaviour may lead to account closure.
20. General provisions
These Terms constitute the entire agreement between you and SendiCash. Section headings are for convenience only. Parties are independent contractors. You may not assign your rights; we may assign ours. If any provision is invalid, the remainder remains in effect. In case of change of control we may transfer collected information. Provisions survive termination as required. Disputes are governed by Ugandan law and subject to Ugandan courts. We are not liable for force majeure events. The English version controls. Acceptance confirms that you agree these Terms supersede prior understandings relating to the subject matter.
